Wenn Sie einen Betrieb des Prostitutionsgewerbes gegründet haben, können Sie diesen von einer Stellvertretung betreiben lassen. Dazu können Sie eine Person oder auch mehrere Personen zur Stellvertretung berufen. Hierfür müssen Sie für jede zur Stellvertretung bestimmten Person eine Stellvertretererlaubnis beantragen.

Die zuständige Behörde kann diese Erlaubnis befristet erteilen.

Die zuständige Behörde prüft dafür, ob die zur Stellvertretung bestimmte Person zuverlässig ist. Sollte sie unzuverlässig sein, lehnt die Behörde den Antrag auf Stellvertretungserlaubnis ab.

Beachten Sie, dass Sie unter Umständen neben der Erlaubnispflicht für das Prostitutionsgewerbe weitere Erlaubnisse benötigen. Auch kann es sein, dass Sie an anderer Stelle meldepflichtig sind. Dies betrifft vor allem folgende rechtlichen Bereiche:

Voraussetzungen

• Sie besitzen eine gültige Erlaubnis oder entsprechende Antrags-ID für einen Online-Antrag für den Betrieb eines Prostitutionsgewerbes.
• Die als Stellvertretung vorgesehene Person ist mindestens 18 Jahre alt.
• Die zu meldende Person hat einer Zuverlässigkeitsüberprüfung zugestimmt.

• Ważne zezwolenie lub odpowiedni dowód złożenia wniosku o zezwolenie na prowadzenie działalności w zakresie prostytucji.
• Uwaga 1: Ze względów administracyjnych możliwe jest jednoczesne ubieganie się o zezwolenie zgodnie z § 12 ProstSchG i zezwolenie na prowadzenie działalności w zakresie prostytucji zgodnie z § 13 ProstSchG.
• Uwaga 2: Warunkiem wstępnym przyznania zezwolenia na prowadzenie działalności w charakterze pełnomocnika pozostaje przyznanie zezwolenia zgodnie z § 12 ProstSchG.
• Minimalny wiek 18 lat dla osoby przewidzianej na zastępcę
• Zastępca musi wyrazić zgodę na sprawdzenie przeszłości w celu przetworzenia.

Verfahrensablauf

Sie reichen den Antrag zur Stellvertretungserlaubnis bei der zuständigen Stelle ein.

Die zuständige Stelle prüft die Unterlagen und führt eine Zuverlässigkeitsprüfung für die zur Stellvertretung vorgesehene Person durch. Hierfür ist deren Mitwirkung erforderlich.

Bei positiver Prüfung erteilt die zuständige Stelle die Stellvertretungserlaubnis.
